These Terms govern your use of the Xsolla Player Platform (“Platform”). By using the Platform, you agree to these Terms. Please read them carefully, as they define your rights and obligations. If you do not agree, you should not use the Platform.

Welcome to the Xsolla Player Platform (the “Platform”), which serves as a central hub where players can discover, connect, and engage with games within the Xsolla ecosystem in various ways. Within the Platform, you can access different gaming activities – all in one place.

The Platform is developed and operated by Xsolla (USA), Inc. (“Xsolla,” “us,” “we”) to improve your game experience. By using the Platform, you agree to be bound by the Terms of Use (“Terms”) set forth herein.

For the purposes of these Terms, the “Xsolla ecosystem” refers to a network of websites, platforms, and other digital products owned or operated by Xsolla, its affiliates, or its partners.

Please carefully read these Terms. If you are under eighteen or the age of majority where you live, don’t hesitate to ask your parent(s) or legal guardian(s) to review them. Please follow these rules, otherwise it’s on you.

1. PLATFORM OVERVIEW

The Platform is a central hub where you can discover, play, and engage with games, participate in activities, and earn and use rewards within the Xsolla ecosystem.

The Platform is available through different versions, including a web portal, a desktop app, and a mobile app (each, a “Platform Version”), and features, content, and services may vary depending on the Platform Version you use, your device, your location, or how you access the Platform.

1. PLATFORM OVERVIEW

1.1. The Platform serves as a centralized hub where earning, collecting, and spending become seamless parts of your gameplay journey. It enables you to launch and play games, participate in promotional activities, earn rewards, and access other related features and services.

1.2. The Platform may be made available through different distribution environments, including but not limited to: (i) a web portal experience (“Games Portal”), (ii) a desktop client or Windows application (“Desktop App”), and (iii) a mobile application for iOS and/or Android devices (“Mobile App”) (each, a “Platform Version”). Certain features, functionalities, content, or services may vary depending on the specific Platform Version you access, your device, your location, or the distribution partner through which you access the service.

1.3. More detailed information about specific Platform Versions and the features applicable to each one is provided in Section 3 of these Terms.

2. FEATURES AVAILABLE WITHIN THE PLATFORM

The Platform includes features that allow you to sign up and log in using Xsolla ID, manage your digital assets through Xsolla Backpack, and participate in rewards campaigns. Xsolla Backpack allows you to manage your purchases, virtual currencies, digital goods, and reward items in one place. You can earn rewards by completing various activities and redeem them for in-game items within the Xsolla Ecosystem.

Use of these features is subject to their respective terms, which we recommend you review carefully.

2. FEATURES AVAILABLE WITHIN THE PLATFORM

The below sub-sections describe products and features that are generally available across all Platform Versions.

2.1 XSOLLA ID

Xsolla ID is a proprietary tool that facilitates and simplifies registration and/or authorization in the products and services that have integrated Xsolla ID. Xsolla provides the user with the Xsolla ID functionality at no cost. Xsolla ID is provided “as is” and with all faults and defects without warranty of any kind. Your use of the Xsolla ID is governed by the Xsolla ID Terms of Use. You will be required to sign up and log in with your Xsolla ID to access and use certain features within the Platform.

2.2 XSOLLA BACKPACK

2.2.1 Xsolla Backpack is a set of instruments and options that allow you to manage your purchases, virtual currencies, digital goods, reward items and transactions while also making your use of the Platform more convenient and functional. Xsolla Backpack provides you with options to manage, store, and update your inventory.

2.2.2 You may purchase, or at Xsolla’s discretion you may be granted, a certain universal virtual currency (referred to as “Virtual Currency”), which will be credited to your Xsolla Backpack balance.

2.2.3 Your use of Xsolla Backpack, including any Virtual Currency credited to your balance, is governed by the Xsolla Backpack Terms of Use that can be found at https://x.la/legal-agreements.

2.3 XSOLLA REWARDS

2.3.1 You can participate in the rewards campaigns organized by Xsolla by completing various actions such as clicking on a link, watching a video, reading an article, subscribing to a channel, joining quiz games for profile fulfillment, joining minigames, participating in giveaways, etc. This list is not exhaustive and may vary depending on the campaign. Participation in rewards campaigns is governed by the Xsolla Rewards Terms that can be found at https://x.la/legal-agreements.

2.3.2 Participate in Xsolla Rewards events, claim your reward and redeem them for in-game items. To receive some types of in-game items, your game or streaming platform account must be linked to Xsolla. Your items will appear in your Xsolla Backpack. Check it regularly to receive more rewards and offers from Xsolla and its game partners. Detailed rules for each Xsolla Rewards event are set by game developers and Xsolla. This includes the number and content of distributed rewards, the participation period, and the conditions for receiving rewards. Rewards promo codes are securely stored in your Xsolla Backpack, and you can check them at any time.

2.3.3 As part of our services, you may also have access to Xsolla Points, which are rewards points that can be earned and stored in your Backpack. Xsolla Points offer various benefits and are governed by the Xsolla Points Terms and Conditions. Please review those terms for detailed information on how Xsolla Points can be received and used.

3. PLATFORM VERSIONS

The Platform is provided through different Platform Versions, including the Games Portal, Desktop App, and Mobile App, each offering different ways to discover and interact with games and participate in rewards campaigns. Depending on the Platform Version you use, you may also be able to create and manage your game library and launch supported games directly within the interface.

Please review Section 3 for more detailed information about each Platform Version and its specific features.

3. PLATFORM VERSIONS

The below sub-sections provide details on the specific Platform Versions.

3.1 GAMES PORTAL

3.1.1 The Games Portal is a player-facing interface and the primary interaction layer of the Platform. It enables you to browse and search the game catalog and launch supported games directly within the interface.

3.1.2 The Games Portal may be made available on websites or digital properties operated by Xsolla, embedded within other Platform Versions, or integrated into the digital properties, websites, or applications of Xsolla’s partners.

3.2 DESKTOP APP

3.2.1. The Desktop App is a desktop-based offering of the Platform designed to enable enhanced gameplay-related features. It allows you to create and manage a personalized game library, view and launch supported games, participate in promotional activities, earn rewards, and spend them within the Xsolla ecosystem. The Desktop App integrates the Games Portal as part of its functionality and provides access to games and related services available through the Games Portal. All features are provided subject to these Terms and may be modified, limited, or discontinued at Xsolla’s discretion.

3.2.2 The Desktop App may, with your consent, scan your device to detect locally installed games and populate your personalized game library. Such scanning is limited to identifying installed game titles and related basic technical identifiers necessary for recognition within the application. You may disable scanning or initiate a new scan at any time in the Desktop App’s settings.

If you choose to connect supported third-party gaming platform accounts (such as Steam, Epic Games Store, or other supported platforms) to your Xsolla ID, the Desktop App may also retrieve information about games associated with the linked accounts and display them in your game library.

Where device scanning is enabled or third-party accounts are connected, your game library may update automatically based on newly detected or synchronized game data. Controls for managing scanning and connected accounts are available in your personal settings.

3.2.3 Within the Desktop App, you may participate in various rewards campaigns which allow you to earn digital content, subject to the terms stipulated in Section 2.3 of these Terms and other applicable agreements. Rewards campaigns may be general or game-specific, i.e. based on games detected in your library or played via the Games Portal. You may be recommended certain rewards campaigns based on contextual information, such as installed games or your country, in order to improve relevance and user experience.

We may collect and analyze certain gameplay-related events for the purpose of validating your completion of rewards campaigns and granting rewards. Depending on the game title, such events may include game launch events, playtime, achievements, in-game progression events, or other gameplay milestones. This functionality is used solely to enable quest validation, reward granting, and related core features.

3.2.4 The Desktop App may enable users to discover and launch so-called Mini Apps, including third-party Mini Apps, within the application environment. Third-party Mini Apps are provided by independent developers. Xsolla is not responsible for the content, functionality, or availability of third-party Mini Apps, which may be subject to separate terms and privacy policies presented within the respective Mini App interface.

3.2.5 Within the Desktop App, you may also access and launch cloud games and metasites, where available. The use of such functionality is additionally subject to the Xsolla Cloud Gaming Platform Terms of Use available at https://x.la/cloud-gaming/terms-of-use and other related documentation.

3.2.6 The Desktop App may be deployed under Xsolla branding or partner branding, including in white-label configurations, and the name, visual identity, content, and certain features may differ accordingly. In such cases, the applicable terms of use and privacy documentation may be provided either by Xsolla or by the relevant partner, depending on the operational model. The terms and policies made available within the relevant application interface at the time of access or use shall govern your use of such application.

3.2.7 We collect limited analytics (such as game launch events, playtime tracking, quest progress and completion events, and reward delivery confirmations) where necessary to provide core functionality and/or for service improvement purposes. Further details regarding the processing of personal data are provided in these Terms and in the Privacy Policy.

3.2.8 From time to time, we may patch, update, or modify the Desktop App (including its integrated content and functionality) for purposes such as security, stability, performance improvements, bug fixes, or feature changes. The Desktop App may check for available updates and notify you when a new version is available. Upon your confirmation, the update may be downloaded and installed automatically.

3.3 MOBILE APP

3.3.1 The Mobile App serves as an environment where users can earn various in-game rewards such as digital items and reward points by completing various actions and quests in the integrated / downloaded games and in the Mobile App and can redeem them within the Xsolla ecosystem. For example, rewards may be redeemed to purchase subscriptions, digital items, games and other offerings which we may periodically provide. The Mobile App may integrate the Games Portal as part of its functionality and provide access to games and related services available through it. All of the Mobile App’s features are provided subject to the present Terms and other applicable terms and may be modified, limited, or discontinued at Xsolla’s discretion.

3.3.2 Within the Mobile App, you may participate in various rewards campaigns which allow you to earn digital content, subject to the provisions stipulated in Section 2.3 of these Terms and other applicable agreements. Rewards campaigns may be general or game-specific. You may be recommended certain rewards campaigns based on contextual information, such as installed games or your country, in order to improve relevance and user experience.

3.3.3 We may collect and analyze certain gameplay-related events for the purpose of validating your completion of rewards campaigns and granting rewards. This functionality is used solely to enable quest validation, reward granting, and related core features.

3.3.4 We collect limited analytics (such as game launch events, playtime tracking, quest progress and completion events, and reward delivery confirmations) where necessary to provide core functionality and/or for service improvement purposes. 5. XSOLLA COMMUNICATIONS

We may contact you via the email address you provide to share important information about your account, updates to our terms or policies, and information related to your use of the Platform. We may also keep you informed about rewards, events, and the latest trends and developments in the gaming world, helping you connect with relevant content and opportunities across the gaming community.

5. XSOLLA COMMUNICATIONS

5.1 Xsolla is your trusted companion in the virtual world. As a registered Xsolla user who has provided an email address, you may occasionally hear from us via email. These messages are designed to keep you informed, engaged, and up to date. For example, we may reach out to:

a. Share important information about your Platform account;

b. Notify you of updates to our policies or terms of service;

c. Provide support and updates related to your personal Platform experience;

d. Invite you to participate in community activities such as commenting on content, joining online games, contests, special events, rewards programs, surveys, or other interactive opportunities;

e. Keep you informed about exclusive rewards campaigns and personalized offers;

f. Offer insights into the latest news, trends, and developments in the gaming industry, including events, product launches, and key updates relevant to gamers and creators alike.

5.2 Our goal is to not only ensure a smooth gaming experience within the Platform but also to connect you with valuable content and opportunities across the gaming community.

6. PERSONAL SETTINGS

You can manage your personal settings within the Platform, including privacy preferences, where available, and certain feature controls. If you want to control what kind of emails or offers you receive from us, you can manage your marketing preferences through your Xsolla ID profile. Depending on the Platform Version you use, additional settings and controls may also be available.

6. PERSONAL SETTINGS

6.1. The Platform may display certain account information derived from your Xsolla ID and may allow you to access and manage such information through available settings. Any changes to your account information are managed through your Xsolla ID profile and are subject to the Xsolla ID Terms of Use.

6.2. The privacy settings section, where available, provides users with basic controls over their personal data processing and related preferences. Additional information about how personal data is processed and how you may exercise your applicable data subject rights is set out in the Privacy Policy, including details on how to submit requests through the designated support channels. Xsolla will respond to verified data subject requests within the timeframes required under applicable law.

You may customize your marketing preferences through your Xsolla ID profile settings. In the Desktop App, access to marketing preference management may be provided via a dedicated link redirecting you to your Xsolla ID profile.

6.3 Within the Desktop App, additional settings may be available. In your personal settings you may enable or disable device scanning for installed games. If scanning is disabled, your game library will no longer update automatically based on newly detected games; however, previously detected games will remain in your library. To remove such games from your library, you have to choose the option for clearing scanned library data.

7. DATA PROTECTION

We care about your privacy, and you should too. Your use of the Platform involves the collection and processing of personal data for purposes such as operating and improving the Platform, managing your account, providing rewards, and sending you relevant updates and information about the Platform. For more details about how we process your data and your rights, please review Section 7, as well as our Privacy Policy and Cookie Policy.

7. DATA PROTECTION

7.1 We collect personal data that you provide directly to Xsolla either through a registration form or when interacting with us using certain Platform features, such as quests, event-based rewards, or surveys, that may require additional information. We may also collect certain information automatically from your device or through cookies, SDKs, and similar technologies. This information is necessary to provide the features and services available within the Platform, as outlined above.

7.2 Types of Personal Data and Purposes of Processing. We may process the following types of personal data for purposes such as:

a. Account Creation and Management. We use your contact and identity information such as email address and phone number to help you register and manage your Platform accounts. We may also use temporary identifiers, device identifiers, or similar references to support limited Platform functionality before you create or verify a full Xsolla ID account. This information also helps us personalize your experience and keep your accounts updated.

b. Support Requests. To assist you quickly and effectively, we may ask for details such as your name, email address, or phone number.

c. Marketing and Communication. With your consent, we may send you personalized marketing messages, including special offers, promotions, and updates about Xsolla or our trusted partners. You can unsubscribe at any time using the link in our emails, or by contacting us at support@xsolla.com. Please note that unsubscribing will not affect any prior processing based on your earlier consent.

d. News and Updates. We may inform you about important changes to your account, our policies, or security measures. If you opt out of receiving such notices, you are solely responsible for staying informed and taking any necessary actions.

e. Optional Participation. Certain Platform features, such as quests, event-based rewards, or surveys, may require additional information (e.g., gameplay preferences or engagement data) to tailor content and issue virtual goods or rewards. Participation in these activities is optional and not required for general use of the Platform.

f. Legal and Regulatory Compliance. We may process your information as permitted or required by applicable law.

7.2.1 Consistent with applicable law we may also use your information or data from your associated devices to:

a. Improve and optimize our apps, websites, services, and features, including through research and analytics;

b. Detect and prevent fraud, security threats, and violations of our policies;

c. Validate quest activity and attribute rewards;

d. Notify you about safety issues or product recalls.

7.2.2 We may collect device identifiers, such as Android ID and Advertising ID, where available, and use cookies, SDKs, and similar tracking technologies to remember information about you and your progress, validate quests, attribute and provide Xsolla Points and rewards, prevent fraud and abuse, and troubleshoot technical issues.

7.3 Access to Personal Data. Only authorized Xsolla personnel who need your data to provide our services have access to it. If we work with external service providers, their access is limited strictly to what’s required to fulfill their task or contract. We take technical, organizational, and legal steps to ensure that your data remains protected in compliance with relevant data protection laws.

7.4 Data Sharing. Certain quests, offers, or rewards available through the Platform may be provided by third-party advertising partners. To make these features available, verify completion of eligible activities, attribute rewards, prevent fraud, support reporting, and settle compensation with partners, we may collect, receive, use, and share limited personal data and activity information with such partners. This may include device identifiers, quest-specific information, installation or engagement events, survey responses, reward status, and other information necessary to verify your participation and provide rewards.

We may use and share collected information within the Xsolla ecosystem to provide, maintain, and improve our services, including to preserve your progress, support rewards attribution, prevent fraud and abuse, and provide a consistent experience across Xsolla products.

7.5 Retention. We store your personal data only for as long as necessary for the purposes for which it was collected, including to provide the Platform, maintain your account or access to the Platform prior to Xsolla ID registration, support rewards attribution, prevent fraud and abuse, comply with legal or contractual obligations, or as long as we have your valid consent where consent is the applicable basis for processing.

Please note that data associated with your use of the Platform prior to Xsolla ID registration, such as rewards, or activity history, may be deleted after a period of inactivity.

7.6 Cookies, and Similar Technologies. Like most online services and mobile applications, we may use cookies, SDKs, device identifiers, and similar technologies in connection with the Platform in connection with our Platform. We use these technologies to provide, secure, and improve our services, remember your preferences, maintain your session, validate quest activity, attribute and provide rewards, prevent fraud and abuse, troubleshoot technical issues, and, where permitted, personalize content or display more relevant ads.

7.6.1 You can adjust your cookie preferences at any time by clicking “Privacy Settings” (or “Do Not Sell or Share My Personal Data” for U.S. users) in the footer. For more details, please review our Cookie Policy. You also may be able to opt-out from having device identifiers collected or processed by using the appropriate setting on your mobile device.

7.6.2 Please note that certain device-level information and tracking technologies are necessary to provide Mobile App’s core features, including, without limitation, rewards attribution. If you do not wish your data to be processed for this purpose, you should stop using these services, uninstall the Mobile App, or contact us as described in our Privacy Policy.

7.7 Your Rights and Choices. You have rights under applicable data protection laws, including: (i) right of access, (ii) right to rectification, (iii) right to erasure, (iv) right to restrict processing, (v) right to object, (vi) right to data portability. These rights are provided under regulations such as the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the California Privacy Rights Act (CPRA). 7.7.1 Please note that certain processing of personal data is necessary for Xsolla to provide you with some Platform features, for instance, quest completion verification and rewards attribution. Therefore, if you object to some of this processing, we may not be able to provide you with such features.

7.8 Communications and Notifications. From time to time, Xsolla may send you updates about in-app events, new quests, and other relevant information. With your consent, we may send you special offers, promotions, or personalized content recommendations. You can manage your marketing preferences at any time via the settings or by following the instructions in our emails. Choosing to opt out of marketing messages will not affect your access to the Platform or its core services.

7.8.1 To enhance your interactive experience, such as participating in reward-based events, we may ask for specific data, like your basic profile information or gameplay preferences. This data collection is optional and only applies to activities where virtual items or digital rewards are offered. This ensures (i) you receive content that’s tailored and relevant to your interests; (ii) we can provide fair, engaging compensation for participation in such activities.

7.9 All data collected is limited to what’s necessary to support your experience and is handled transparently, lawfully, and in accordance with our Privacy Policy, Cookie Policy, and all applicable data protection regulations.

7.10 Please note that this practice of exchanging limited personal data for enhanced content access is standard in the gaming industry. It does not constitute a sale of your personal data or any form of coercion. Instead, it allows us to offer you a richer, more personalized gaming experience.

8. YOUR SAFETY

You are responsible for keeping your profile information accurate and your Xsolla ID secure, and you may not share your Xsolla ID details or use another user’s Xsolla ID without the owner’s permission. You must use the Platform in accordance with these Terms and applicable laws. Among other restrictions, you may not engage in harmful, abusive, or fraudulent activities, misuse content, interfere with or disrupt the Platform, or violate the rights of others.

8. YOUR SAFETY

8.1 By registering with Xsolla, you agree that the information that you provide is true, accurate, current, and complete. Without limiting any other provisions of these Terms, you may not use false identities or impersonate any other person or use a username (or nickname) or password that you are not authorized to use. You are solely responsible for maintaining the confidentiality and security of your Xsolla ID and for all activities that occur under your Xsolla ID within the Platform. You represent and warrant that your profile information will be accurate at all times. To the extent permissible under applicable law, we cannot and will not be responsible for any loss or damage arising from your failure to comply with the foregoing requirements. You agree to comply with all and any local, national, and international laws, rules, and regulations (above and hereinafter “applicable law”) regarding online conduct and the transmission of information on the internet and governing the parties’ respective rights, duties, and obligations hereunder, as applicable.

8.2 You may not transfer your Xsolla ID details and access to any other person, and you may not use anyone else’s Xsolla ID at any time without the permission of the holder of such Xsolla ID.

8.3 You agree not to use your Platform account(s) for any of the following purposes:

a. Transmitting content that is unlawful, threatening, harmful, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or otherwise objectionable based on race, ethnicity, or other factors;

b. Harming or harassing any person or entity in any way;

c. Impersonating any individual or organization, including but not limited to Xsolla, its employees or agents, or community moderators, or misrepresenting your affiliation with any person or entity;

d. Falsifying or manipulating identifying information to conceal the origin of any content transmitted through or stored in your Platform account(s);

e. Sharing content that you are not authorized to disclose under applicable laws or contractual obligations (such as insider information, proprietary data, or information protected by nondisclosure agreements);

f. Transmitting material that infringes on the intellectual property rights of others, including copyrights, trademarks, trade secrets, or patents;

g. Uploading, posting, or sharing unsolicited or unauthorized advertisements, promotional materials, spam, mass emails, spoofed email addresses, chain letters, or content related to pyramid schemes or similar solicitations;

h. Transmitting or distributing any files or programs that contain viruses, malware, or other code designed to damage, interrupt, or limit the functionality of software, hardware, or telecommunications equipment;

i. Interfering with or disrupting Xsolla’s servers or networks, or failing to comply with any network rules, policies, or procedures;

j. Violating any applicable laws, whether intentionally or unintentionally;

k. Collecting, storing, or sharing personal information about other users without their explicit consent.

9. PLATFORM OWNERSHIP

Xsolla and its licensors own all rights in and to the materials available on the Platform (“Materials”), which are protected by applicable intellectual property laws. You may not use the Materials without our permission. Xsolla is not responsible for content provided by game partners or third parties. 9. PLATFORM OWNERSHIP

9.1 The Platform is owned and operated by Xsolla (USA), Inc. Visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Platform (“Materials”) provided by Xsolla are protected by intellectual property and other laws. All Materials included in the Platform are the property of Xsolla or its licensors. Except as expressly authorized by Xsolla, you may not make use of any Materials. We reserve all rights to the Materials not granted expressly in these Terms.

9.2 Xsolla is not responsible for the content that our game partners upload to our Platform. We do not endorse, guarantee, or warrant any content or service provided by game partners.

9.3 If you believe that any content on our Platform violates your rights or is otherwise objectionable, please notify us at legal@xsolla.com. If you believe that there is a copyright infringement, you must provide us with all possible information confirming the fact of the copyright infringement. We will investigate all complaints and take appropriate action, including removing the content if necessary.

9.4 Any links to third-party websites or resources that we provide are only for convenience and we are not responsible for the content, products or services on those websites or resources.

10. DISCLAIMERS. NO WARRANTIES

The Platform and all Materials are provided “as is” and “as available,” without warranties of any kind. Your use of the Platform is at your own risk, and we are not responsible for any resulting damage or loss to the fullest extent permitted by law.

A. THE PLATFORM, ALONG WITH ALL MATERIALS AND CONTENT AVAILABLE THROUGH IT, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. XSOLLA MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PLATFORM OR THE MATERIALS AND CONTENT IT OFFERS. WE DO NOT GUARANTEE THAT THE APP, ITS FEATURES, OR ANY CONTENT PROVIDED WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE WARRANT THAT DEFECTS, VIRUSES, OR OTHER HARMFUL COMPONENTS WILL BE IDENTIFIED OR CORRECTED.

B. Any advice or information you receive from Xsolla, whether written or spoken, does not create any warranty not explicitly stated in these Terms. We are not responsible for any damage or loss resulting from your use of the Platform or interactions with other users. You understand and agree that you use the Platform and any of its features at your own discretion and risk, and that we are not liable for any damage to your device or system, or for the loss of data, including user-generated content.

C. The disclaimers, limitations, and exclusions described in this Section apply to the fullest extent permitted by law. Xsolla does not disclaim any rights or warranties that cannot be excluded under applicable law.

By using the Platform and accepting these Terms, you make the representations and warranties set out in this Section 11.

11. REPRESENTATIONS AND WARRANTIES

Please note that by accepting these Terms, you confirm and represent the following to Xsolla:

a. You are of legal age in your country or region of residence. If you are between the minimum required age and 18 (or the age of majority where you live), you and your parent or legal guardian must review these Terms together. Parents and guardians are responsible for the actions of users under 18 who access Xsolla.

b. You are creating and using your Platform account(s) voluntarily, with full understanding of your actions and their implications.

c. You agree to register your Platform account(s) using your own details and not to impersonate any other individual or attempt to conceal your identity from Xsolla.

d. You understand that the telecommunications infrastructure and internet services necessary to access Xsolla are outside of Xsolla’s control, and we cannot be held responsible for service interruptions, slowdowns, or other network-related issues.

e. You agree not to use any tools or services intended to hide or alter your real location for the purpose of accessing restricted content, engaging in illegal activities, or circumventing government-imposed limitations.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Xsolla is not liable for any damages arising from your use of the Platform, and our total liability is limited as set out in this Section 12.

12. LIMITATION OF LIABILITY

A. To the fullest extent permitted by law, Xsolla will not be liable to you for any indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of profits, loss of goodwill, or other intangible losses) arising from or related to your access to or use of, or inability to access or use, the Platform or any materials or content therein. This applies regardless of the legal basis, whether it be warranty, contract, tort (including negligence), statute, or any other theory, and even if Xsolla has been advised of the possibility of such damages.

B. Except for claims related to breaches of proprietary rights as described in Section 9 and indemnification obligations under Section 13, the total cumulative liability of either party, together with its affiliates, arising from or related to these Terms (regardless of the cause or form of action, including negligence) shall not exceed one hundred U.S. dollars ($100). This limitation applies whether the claim is based in contract, tort, or any other legal theory, and it does not affect your obligation to make any required payments under these Terms. Neither Xsolla nor its affiliates will be liable to you for any offering unless damages are established by a final judgment from a court or arbitrator, and subject to the limitations set out in this Section.

C. Each provision in these Terms that limits liability, disclaims warranties, or excludes damages is intended to allocate risk between the parties and forms an essential part of the overall agreement. These provisions are independent and enforceable separately from the rest of the Terms. The limitations outlined in this Section will still apply even if a limited remedy is deemed to have failed in its essential purpose.

If we are sued or otherwise put in harm’s way because of something you did, you will bear the associated costs and damages.

14. MISCELLANEOUS

14.1 Governing Law. These Terms, including their interpretation and any disputes arising from them, are governed by the laws of the State of California, USA, without regard to any conflict of law principles that would apply the laws of another jurisdiction. Any claims or disputes related to purchases of the digital content will be resolved according to the End User License Agreement.

YOU AND XSOLLA AGREE THAT ANY CLAIMS MUST BE BROUGHT INDIVIDUALLY, AND NOT AS PART OF A CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING.

14.2 Term and Termination. These Terms remain in effect until terminated. You may terminate them at any time by notifying Xsolla or by deleting the applicable Platform Versions.

14.2.1 Xsolla reserves the right to terminate these Terms immediately if you breach any of their provisions or if we reasonably believe you have not complied with them. We may also take appropriate action, including restricting access or banning users, if your conduct violates the letter or spirit of these Terms. Where possible, and if the issue can be resolved, we’ll offer you a reasonable opportunity to correct it.

14.3 Modifications. We may update these Terms from time to time at our sole discretion. We also reserve the right to modify or discontinue features of the Platform at any time, with or without notice. New features may be introduced without requiring your prior consent, though you always have the option to decline using them. We are not liable for any modifications, feature removals, or temporary or permanent interruptions to your access to the Platform.
